Terms and Conditions

Introduction

HealthCRAD Wholesale is the Visionary brand of Bhavah Healthcare Private Limited (BHPL). We at HealthCRAD Wholesale provide services to all registered medical retail stores. Accessing or using our HealthCRAD Wholesale App (herein referred to as platform) for any reason, you are a User subject to the notices, terms, and conditions set forth in these Terms & Conditions Agreement. The HealthCRAD Wholesale Platform is owned and operated by BHPL, a company duly incorporated under the provisions of the Companies Act 2013. By accessing or browsing the BHPL Platform and using the Services as defined below, you indicate your agreement to all the terms and conditions in this Agreement. If you disagree with any part of the Terms and Conditions, then you may discontinue access or use of the BHPL Platform.

1. Eligibility

1. You are legally registered as a retail pharmacy with all the required licenses and documentation.
2. You are legally competent to contract, and otherwise competent to receive the Services as defined in these Terms and Conditions.
3. Persons who are incompetent to contract within the meaning of the Indian Contract Act, 1872, including undischarged insolvents, etc., are not eligible to use the BHPL Platform.
4. BHPL reserves the right to terminate your membership and/or refuse to provide you with access to the Platform if BHPL discovers that you are not legally registered as a retail medical store having all the necessary documents.
5. These Terms and Conditions are published in compliance with and governed by the provisions of Indian laws, including but not limited to:
(a) The Indian Contract Act, 1872
(b) The Indian Information Technology Act, 2000
(c) The Drugs and Cosmetics Act, 1940
(d) The Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954
(e) The Consumer Protection Act, 2019

2. Your Use of the BHPL Platform

By using the BHPL Platform, you expressly agree to be bound by the Terms and Conditions. If you do not agree with any of the Terms and Conditions, please do not use the BHPL Platform.

1. You are solely responsible for the personal information you provide on the BHPL Platform.
2. You will provide accurate and complete information everywhere on the BHPL Platform based on which you will receive the Services.
3. You are solely responsible for protecting the security and confidentiality of the password and identification assigned to you.

3. Prohibited Content

You shall not upload, distribute, or otherwise publish through the BHPL Platform any prohibited content, including but not limited to:

1. Content that is harmful, defamatory, or obscene.
2. Content that violates any law in India.
3. Content that impersonates another person or misrepresents your identity.

4. Delivery and Charges Policy

Delivery is subject to valid licenses and permits where applicable. BHPL endeavors to deliver within the promised timeframe; however, certain factors such as strikes, product shortages, or force majeure events may cause delays.

Once order detail of yours is verified by us, the order will be received instantly and shipped within 24 hours.
The standard delivery time is 72 hours, or 3 working days.
Delivery charges and applicable fees will be displayed at checkout.

5. Returns & Refunds

User may return eligible products within 2 days after delivery of the product, if the received product is damaged or different from the ordered product.
If user wants to replace the product then the replacement request will be processed and within 24 hours the product will be picked up for replacement, however if the user wants to return the product and get refund, then once the product is picked up for return the amount will be refunded within 3 working days.

6. Limitation of Liability

BHPL is not liable for special, indirect, or consequential damages arising from your use of the BHPL Platform. The liability is limited to the cost of the product in question.

We may revise these Terms and Conditions periodically. Please review them regularly to ensure you are aware of the terms that apply at any time.
